These Terms and Conditions ("Terms") govern access to and use of the Trouveris application, software, mobile apps, desktop apps, websites, and all related services (collectively, the "Service").
By accessing or using the Service, you explicitly confirm that you have read, understood, and fully accepted these Terms without limitation or reservation. If you do not agree, you are not authorized to use the Service.
Definitions
For the purposes of these Terms:
1. Nature of the Service
Trouveris is a software tool that uses intelligent on-device algorithms to enable image search, classification, recognition, indexing, and retrieval.
The Service is provided strictly as a technical tool. Trouveris:

2. User Responsibility – Full Assumption of Risk
The user bears sole, exclusive, and complete responsibility for:

3. Content, Faces, and Third-Party Rights

The user agrees to fully indemnify, defend, and hold harmless the Company, Trouveris, and their directors, officers, employees, and partners from any claim, damage, fine, loss, legal action, or expense (including reasonable attorneys' fees) arising from user content, misuse of the Service, or violation of third-party rights, except to the extent finally determined to have been caused solely by the Company's wilful misconduct where such limitation is mandatory under applicable law.
4. Intelligent Systems Disclaimer – No Reliance
The Service relies on automated intelligent systems which:

All software, intelligent system models, designs, trademarks, and documentation remain the exclusive property of Trouveris or its licensors.
No rights are granted except those strictly necessary to use the Service.
7. Termination and Account Closure
Trouveris may suspend or terminate access at any time, without notice, if the user violates these Terms or creates legal, security, or reputational risk.
Where the Service offers account deletion or closure, you may request closure subject to the Privacy Policy and applicable law (including retention required for taxes, fraud prevention, or legal claims). Termination of access does not remove obligations that accrued before termination (including indemnity and payment obligations).
8. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE".
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TROUVERIS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under mandatory applicable law (including gross negligence or wilful misconduct, where applicable).
The Service may provide tools for file deletion, trash, or automated culling. You acknowledge that AI-assisted or automated actions may produce unintended results. The Company shall not be liable for loss of data, corruption of files, accidental deletion, service interruptions, or errors in AI-based selection except where mandatory law provides otherwise.
10. File Deletion and User Responsibility
The Service may provide tools enabling users to mark files for deletion, move content to a temporary trash environment, or permanently delete content.
By confirming a deletion action, the user acknowledges and agrees that:
Users are solely responsible for maintaining backups of any data they consider important.
11. Subscription Verification and Feature Availability
Certain advanced features of Trouveris are available only under a paid subscription plan. Access to these features is granted on a license basis and is subject to successful subscription verification.
Trouveris is designed to operate primarily offline. However, to maintain access to paid features, the application must periodically verify the subscription status by connecting to Trouveris servers.
If the application is unable to verify the subscription status for an extended period of time, a temporary limitation or downgrade of paid features may occur. No user content will be deleted as a result of such limitation.
Once verification is successfully completed, all entitled features will be restored immediately.
Trouveris reserves the right to suspend or limit access to paid features in cases of non-payment, subscription expiration, or prolonged inability to verify subscription status.
12. Pricing and Plan Modifications
The Company reserves the right to modify subscription fees, introduce new pricing plans, adjust features included in existing plans, or discontinue certain pricing structures at its sole discretion.
Any price changes affecting active subscriptions will be communicated in advance and will take effect at the next billing cycle, unless otherwise required by applicable law.
Continued use of the Service after the effective date of a pricing change may constitute acceptance of the updated pricing where permitted by law.
The Company may offer promotional pricing, temporary discounts, or region-specific pricing at its discretion. Such offers do not create entitlement to future or permanent pricing conditions.
The Company may change pricing for new users at any time without prior notice.
For existing subscribers, pricing modifications will apply only after appropriate notice and at the start of a new billing period where required by law.
Nothing in these Terms shall be interpreted as guaranteeing the continuation of any specific pricing structure, feature set, or subscription model.
13. Commercial Communications
The Company may communicate with users via email, push notifications, and in-app messages for service-related purposes (e.g. security, receipts, verification) and, where permitted by law, for marketing, product updates, and engagement.
Where applicable law requires separate consent for electronic direct marketing, such communications will be sent only in compliance with those requirements. You may withdraw marketing consent or use unsubscribe mechanisms as described in the Privacy Policy, without affecting essential service messages necessary to operate your account.
14. Governing Law
These Terms are governed by the laws of Switzerland, excluding conflict-of-law rules.
Exclusive jurisdiction lies with the courts of Switzerland, without prejudice to mandatory consumer protections or jurisdiction rules that cannot be waived under the law of your country of residence.
15. Severability
If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force and effect.
